Driver to sue council after potholes damage his Mercedes

A Southampton resident plans to sue his local council after potholes caused £3,000-worth of damage to his car.

Dean Harrigan claims that ‘massive craters’ on a roundabout in the city cracked and bent all four wheels on his Mercedes-Benz C63 AMG.

The 43-year-old says that his front left tyre burst after he hit the broken section of road, and recalls hearing a loud bang.

After taking his car to Mercedes to be checked over, he was told that the damage received meant all four wheels would need to be replaced. He claims that the car then sat on his driveway for three months while he waited for it to be fixed “because I didn’t want to risk my life in it.”

He has since paid £1,200 to have the wheels refurbished, but claims this has reduced the value of his car and wants the council to pay the full amount for replacements.

Council contractor Balfour Beatty turned down his appeal for reimbursement, claiming it is not liable for repairs to the vehicle.

A council spokesman said: “We are unable to comment on individual cases.

“However, we work with our partner organisations on a systematic process of highway safety inspection, defect intervention and repair applied in accordance with our policy.

“This includes our routine inspection of the highway network, alongside the investigation of defects reported to us by road users.

“In order for claims for compensation to be considered then there would need to be evidence of negligence.”
